History, zoning, procedures, etc.

The information below is not meant to serve as an official explanation of City of Keller procedures nor to serve as official notification of any possible development. It is for information only, based on the experience of the Villas at Town Center to date. If you wish to know if any development is in the works we encourage you to check with the City of Keller.

  • The plot of land directly to our west (on the north side of Bear Creek Parkway) is privately owned and is permitted to be developed. (Map below) Thankfully any serious development interest shown to date has been minimal.  
  • In public documents it is usually referred to as: “3.79 acre tract of land out of the Pamela Allen Survey, Abstract No. 28, on northeast corner of Bear Creek Parkway and Country Brook Drive, approximately 400 feet west of Keller-Smithfield Road South”, and zoned TC (Town Center).  (some says 3.34 acres)
  • It is directly behind the homes on Toulouse Lane and some at the southern end of Versailles Lane.

HISTORY:

  • May 13, 2021 - The website for the site has been taken down and neither calls or emails have been returned from the developer.  The city has not additional information.  It appears this project is either cancelled or at least on hold.  We will keep the HOA members informed.
  • October 14, 2020 The TIA [Traffic Impact Assessment] and the Tree Survey and preliminary soils investigation coupled with the issues with all of the consultants relating to C-19 have slowed the process insofar as have the necessary material to submit to the City of Keller. We should have most or all of the consultants work by the end of the month to prepare for submission.

  • October 06, 2020 the city (P&Z) has NOT received any submissions form the developer about this property as of yet.  We will continue to monitor the situation.
  • August 06, 2020 a meeting was held with the homeowners backing up to the new development at the meeting room at the new Hampton Inn in Keller.
  • August 05, 2020 the Carbon Companies sent an update and results of a study by Timothy J. Duduit, P.G. where it was revealed that there is NOT a spring on the property addressing a concern of several residents at the Q&A meeting.  The full report can be found here:  https://www.thegreysononbearcreek.com/
  • July 15, 2020 a Q&A meeting at the Keller City Council Chambers was held with the developer, The Carbon Company, and the homeowners of the HOA, where they presented to the HOA to a mixed-use residential community they plan on presenting to the City of Keller.  Additional information can be found here https://www.thegreysononbearcreek.com/
  • July 07, 2020 a meeting was held between the Carbon Companies with the HOA Board.  Dave & Rick met with the developers to discuss their plan and then requested to meet with all homeowners to present their community to all homeowners.
  • June 30, 2020, Ed Garahan, from The Carbon Company, reached out to the HOA Board and requested a meeting to present the development plan they had put together to the HOA Board.
  • June 2019 a Feasibility Study was performed.  No further information is available at this time.
  • Since the building of the Villas in the early 2000’s there have only been 2 attempts to build on that land. Both ultimately opted to move to different locations: one was an assisted living facility (2011; moved to Keller Smithfield) and one was townhomes (2014; moved to Pate Orr, never submitted for a vote to City Council after we showed strong opposition)
  • Historically the Keller City Council has expected the people developing projects to be good neighbors and to take our vantage point into account.  (In 2011 that meant the developer building a brick screen wall between our homes and any development.)
  • There is a 10' utility easement behind the back fences on Toulouse Lane and Versailles Lane.

OFFICIAL NOTIFICATION:

  • If a proposed project meets the normal requirements of Town Center zoning (shown as P on the list), then it will go through Planning and Zoning and then City Council and could be approved. We are not required to be informed of a project that falls properly within Town Center zoning. However, we ARE notified when projects require a Special Use Permit (those marked SUP) or if anyone attempts to rezone the land.
  • We will alert everyone in our neighborhood via email if we hear or see signs of possible development (surveying, signage, announcements from the city or an item on a meeting agenda for the City Council or Planning and Zoning).
  • If you see activity over there please make sure the HOA board is aware of it.
  • Any documents provided to us at that time will be added to this page and we will provide our homeowners with the proper procedures for responding to the proposed development should you wish to do so.
